Homeowner Prevails Over HOA in Dispute Over Political Sign

Missouri State Court Decision re issue over a member’s sign –

A Jefferson County judge ruled that an HOA violated a member’s right to free speech by banning him from putting a political sign in his yard in support of a local candidate that was running for a city position. The HOA contended that the member’s placement of the sign violated a covenant in the HOA’s governing documents that prohibited most signs. In ruling in favor of the homeowner, the judge stated “The right of free speech under our constitution is not only secure from interference by governmental or public bodies, but under certain circumstances from interference by private actors as well.”
